I think for me it's more a matter of not just the fact that the fender is sitting on the tire but that it's made of such thin, brittle material. If it were made out of the same shatterproof material that my KLR fenders were made of it probably wouldn't be an issue. It seems that the material the rear fender is made of on the bike should have been used for the front fender also, it's much tougher. I have gotten a rock jammed between the tire and fender on two different ocassions on just a gravel road, the last one of which created a crack on the lower edge on the fender. I talked to some folks who have installed more aggressive tires that, being able to pick up even larger stones, have almost destroyed their front fenders. The thin low-mount fender kinda looks out of place with the massive industrial-looking Motech bash plate and I think a higher mount fender would more compliment the look of this particular bash plate that some owners prefer.
