Hyperlite Legality?

We were discussing my new Hyperlites at work the other day and somebody popped out with the following Arizona statute. Part C seems to indicate that a flashing auxiliary brake light would be forbidden… unless you say that a vehicle stopped on the roadway would require “unusual care in approaching, overtaking or passing.“

Which you could reasonably argue.:fineprint:

Any experience with the legality of Hyperlites or similar in Arizona?

The fine print:

C. Except as provided in subsection D or E of this section, flashing lights on motor vehicles are prohibited except either:
1. On authorized emergency vehicles, school buses or snow removal equipment.
2. As warning lights on disabled or parked vehicles.
3. On a vehicle as a means for indicating a right or left turn.
D. A vehicle may have lamps that may be used to warn the operators of other vehicles of the presence of a vehicular traffic hazard requiring the exercise of unusual care in approaching, overtaking or passing. The vehicle may display these lamps as a warning in addition to any other warning signals required by this article.

Probably illegal, probably worth chancing it.

I doubt you'd get away with the "situation requiring unusual care" argument in court, but it might work on a cop. But then again, any cop who would stop you for it, would probably not give in so easily! :biggrinjester:

Does flashing mean continuously? How long does it have to flash for? Hyperlights only flash for like 3 or 5 sec before they come on full. This may be how they get around the law. They aren't flashing continuously. Kind of like pumping the brake peddle, would that be considered flashing?

That may be an option, but mine flash until the brake is released. When I'm sitting at a stoplight at the bottom of an offramp, I really do want to get the attention of the cager sailing up behind me. Before Hyperlites I typically would lightly pump the brake in such a situation, until the light turned green.

Yea...I agree. What I do is release the brake and reapply then the flashing sequence starts again. 3-5 sec flash then on full. I'll do this a couple of times just to make sure if anyone is coming up from behind they see me.

Here in UTAH , hyper lights are illegal, period. A state trooper wrote me when I asked the question, unless a vehicle belongs to an emergency response group or city maintenance, no hyperlights of any color. This law is hopefully going to change one day - I am using a unit called ' BackOff " that has my lights flashing at a regular speed and then stops, and restarts...... sofar no problems:thumbup:

Andreas, I'm wondering if the trooper knew what Hyperlights are? If you're ok with a Backoff modulator, I'd sure think the Hyperlights would be ok as well. I know Calif has a different requirement such that Hyperlights sells a different modulation for use there, but I've had no trouble when I passed through the norther part of the state a couple times.

The trooper knew about hyper-lights, that's much of the same system they use on vehicles and bikes. The BackOff relay uses existing brake lights on the bike's, hyper lights are extra bright and flash much faster.

The trooper is all for hyper lights, but until it's legally allowed ...........

Now you've got me thinking...did I have my hyperlights installed when I did a loop through Utah a few years ago? Nah, I think I installed them a few months after that trip, but now that means I can't go back.

I've had Hyperlites for a year. Although I live in California I bought the ones that flash continuously (Ca. only allows 3 flashes & then has to be continous) No problems yet with police & have had a moto officer behind me at a light. Once traffic has stopped behind me I release my brake to stop the blinking.

Hyperlites

I've removed the reflectors and mounted the HyperLites on the license plate bracket using the double-stick tape they provide. The wiring was simple and the results were impressive. I'm very happy with the way the HyperLites work and give me much more visibility from the back. They do get people's attention (and that's what you need when the guy behind you is texting on his phone!)
