Ontario to ban kids under 14 on Motorcycles!

I don't have any kids under 14, but I think there is something fundamentally wrong with this bill:

Quote:
Bill 117 2008
Quote:
An Act to amend the Highway Traffic Act to prohibit the driving and operation of motorcycles with child passengers

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. The Highway Traffic Act is amended by adding the following section:
Prohibition of passengers under 14 years old on motorcycles
38.1 No person shall drive or operate a motorcycle on a highway if another person under the age of 14 years is a passenger on the motorcycle.
Commencement
2. This Act comes into force on the day it receives Royal Assent.
Short title
3. The short title of this Act is the Highway Traffic Amendment Act (Child Passengers on Motorcycles), 2008.

EXPLANATORY NOTE
The Bill amends the Highway Traffic Act to prohibit driving or operating a motorcycle on a highway while a person under the age of 14 is a passenger on the motorcycle, with a view to promoting safety on Ontario's roads and protecting youth from preventable injuries.

Bill 117 was tabled for first reading by Oak Ridges MPP Dr. Jaczek on Monday. I can find nothing on her website to explain why she's brought the Bill to the Legislature. I emailed her to explain her rationale behind the Bill. I also checked the Motorcyclists' Confederation of Canada website to see if there was anything on it - nothing so far - but MPP Donna Cansfield still doesn't want us in HOV lanes.

I'll let you know if and when I hear back from Dr. Jaczek.

This amendment makes no sense what so ever. To say that it is for the safety of children misses the mark. There are better areas to focus their attention. School buses have no seat belts, have seats sized for adults and no booster seats. I have seen hundreds of kids on buses but maybe a dozen on motorcycles. My kids are required to use a booster seat in my vehicles until they are 8 or 9 and weigh at least 80 pounds. This is to ensure they are the proper size for the seat and belting system. I see nothing wrong with a child riding on a motorcycle providing they are wearing the proper gear and they can put their feet flat on the passenger pegs.

How do they plan to enforce this? In full gear, a 12 year old will look like a small stature adult. Will every guy with a petit wife/girlfriend be harassed?

I for one plan to contact my local MPP. Anyone else who thinks this is crap should do the same.

I particularly like the point of no seat belts in school buses.

That is something I could never understand - even when I was a kid riding the "twinkie" to/from school.

Are you kidding me! I fail to see how this will promote safety. And wtf with this preventable injuries crap? Heck, all of us, leave the driveway with the notation of avoiding a collision, aka a preventable injury.

Those sneaky Government buggers, trying to slide this in while the "cell phone" proposal/bill is getting all the media attention.

Isn't a motorcycle with a rider and passenger aboard about as High Occupancy as you can get? Their real adgenda is getting bikes completely off the roads and the motorcycle industry gone. I hear they don't like guns much either.

I see no evidence of much thought being put into this in terms of it being part of an agenda to eliminate motorcycles from Ontario roads. I think an MPP gets a few loud voices in his or her ear screaming about the crisis presented by something like children on motorcycles, all backed up by a dubious doctoral thesis on the special dangers children face as motorcycle passengers. The danger is that the Bill will bobble its way through first and second reading in the legislature and get passed without any careful examination of its propriety.

I've contacted the Motorcyclists' Confederation of Canada to see what they have to say, as well as the moving MPP's office. The rest of us should be contacting our MPPs. Ask your MPP to justify the Bill.

Seems to me a properly dressed child(safety gear) with both feet on the pegs is a lot safer than a 13 year old doubling another 13 year old on a peddle bike with no safety gear. A lot of our so-called intelligent politicians should give their heads a shake. They tend to do this stuff just to justify their jobs and have a record of accomplishments come election time.
Hopefully this "brilliant idea" won't come to pass. We seem to get a lot of unnecessary laws while the powers that be dodge the real issues. Real issues mean real work.
