Sent the following e-mail... Titled "Loss of use" to the Insurance agent this morning at 8:15:

Not sure why it really has taken this long to make the decision concerning liability but I just looked up motorcycle rental rates for a comparable bike and they are $100/day and it has been 51 days so far...

Checked my voicemail a few minutes ago... seems they are sending a check for the repair of the motorcycle...

assumption is they've delayed your claim for 51 days? believe in the check when you receive it.

Could that be considered theft over $5000?

I don't presume to understand why it would be in their interest to delay the claim but got an e-mail a couple hours later telling me that they are sending another check to reimburse me for the towing and the protective gear. I'll be sure to let them know if the check(s) don't show up within a couple of days.

Concidering my shoulder is still messed up and the weather we have had to ride in recently... if they actually pay it out at that rate I won't press charges... because in the long run I probably have another 10 or more days to add to that once the check shows up. At least as I see it, I don't get use back until the shop is done with the repairs and they haven't even ordered parts yet.

Funny thing is I quoted rental for a 650... I should go back and see if a 1000 cc bike costs more to rent.

I got fairly quick INS pay out on the initial portions of my claim for an accident July 2011. They paid the allotment on the bike and property loss. That took a couple months, I think.
They aren't worried about your time loss, they are interested in their procedures and getting the paper work right.
It took a whole freaking year for one of my physicians to send the paper work so I could get my pain and suffering check. Since it was an unexpected amount I wasn't that unhappy about waiting.
But I'm not the 'me right now' type. Patience grasshopper.

To Notacop... I do plan on waiting them out for a good settlement and my finances are in good enough order to manage that

I guess I could do this but I am wondering how it could help except to let them know that I know which strings to pull. I could've cried foul earlier but did not want to send the message of inpatience or desperation since I am neither and hopefully avoid any lowball settlement offers.

Patton, when I suggested I could seek counsel the INS lady reminded me that lawyers take 30% and may not get much more than they offered. I thought that was a decent answer especially since I didn't expect to get more than I had as personal medical expenses. The P and S amount was unexpected.

By "INS lady" I presume you mean the claims person you dealt with but you didn't say whether she was from your insurance company or the other person's insurance company. Makes a little bit of difference as it is well known that besides investing collected premiums, minimizing payouts is the other way insurance companies make their money. In the past I have always had my own insurance company to deal with the other insurance company and things worked out well. This is the first time I have been injured in any accident and the first time I haven't had my own insurance to represent me.

I don't mind leaving an attorney out of the equation but I won't submit to being short changed for the purpose of keeping an attorney out of it.

My Claim adjuster said something like that as well. " Lawyers usually take a third" I said well then you can save a third by keeping my lawyer out of it.

I am at 36 days loss of use. I told them on day 3 that NW adventure rents Stroms for $120 a day. They told me that was unreasonable and that they would provide a rental car for transportation. So I am expecting my loss of use to be either the cost of a rental car per day for the lost time OR the difference in the miles I have driven beteween my 40 MPG bike and my 9 MPG truck @ 80+ miles a day ( the math hurts my bran) OR they can give me the $5250 I paid for the Wee I bought to carry me over till my Vee is repaired OR I can write a recipt to myself for rental of the Wee @ X dollars a day.

I'm honestly thinking that it will be somewhere around $25-$30 a day loss of use.

Notacop, If you dont mind me asking what did they offer you for P&S?

My attorney said that my case is so straight forward I dont need him unless they get froggy.
