I would guess that the tank capacity is calculated by its designed dimensions, without consideration of the apparatus inside or the fact that it cannot be filled to complete capacity because of the air space around the filler neck.
It's like anything else related to "official" specs: the manufacturers put their best foot forward even if it's not into the real world.
